General Terms and Conditions of Sale

1. Seller and scope

These general terms and conditions of sale (“GTC”) govern all orders placed on the website ube-drink.ch (the “Site”), operated by Guillaume Rième, sole proprietorship (trading as UBÉRA), with registered office at Route de Berne 223, 1066 Épalinges, Switzerland, UID number CHE-417.515.415 (the “Seller”, “UBÉRA”, “we”).

Contact: contact@ube-drink.ch. By confirming their order, the customer acknowledges having read these GTC and accepts them without reservation. Acceptance is recorded and time-stamped at the moment of payment.

2. Products

The Site offers foodstuffs — purple yam powder (ube, Dioscorea alata), sourced in the Philippines and packed in Switzerland — as well as preparation accessories. The photographs illustrate the products as faithfully as possible; minor variations in shade may occur, as the colour of ube is of natural origin.

The list of ingredients, the best-before date and the storage conditions appear on the packaging of each product. In case of allergy or intolerance, check the label before consumption.

3. Prices

Prices are shown in Swiss francs (CHF), all taxes included. Swiss VAT included — reduced rate of 2.6% for foodstuffs, standard rate of 8.1% for accessories and delivery. VAT no.: CHE-417.515.415 VAT . Delivery costs are displayed before the order is confirmed and summarised on the payment page.

The Seller reserves the right to change its prices at any time; the applicable price is the one displayed at the moment the order is confirmed.

4. Order and conclusion of the contract

Orders are placed online: adding products to the cart, entering the delivery details, accepting the GTC, then payment. The contract is concluded at the moment the payment is confirmed. A receipt is sent automatically to the e-mail address provided.

The Seller may refuse an order in the event of suspected abuse, an obvious pricing error or product unavailability; in that case, any amount already charged is refunded in full.

5. Payment

Payment is made online via our provider Stripe (SSL encryption). The available payment methods are displayed at checkout. Card data is processed exclusively by Stripe and never passes through our servers.

6. Promotional codes

Promotional codes are valid on the Site during their activation period, cannot be combined with one another, are not convertible into cash and do not apply to delivery costs. A code applies to the order subtotal at the moment of payment.

7. Delivery — Switzerland only

UBÉRA delivers exclusively within Swiss territory. No shipping abroad is offered or possible: the order form only accepts Swiss addresses, and any order whose delivery address is located outside Switzerland will be cancelled and refunded in full. Shipments are made by Swiss Post.

Delivery is made to the address provided when ordering. Delivery costs amount to CHF 7.90; delivery is free of charge from CHF 50.00 of purchases (amount after deduction of any discounts). The applicable amounts are those displayed at the time of the order.

Indicative delivery time: 2 to 5 working days from confirmation of payment. Delivery times are given for guidance only; a delay does not give rise to any claim for damages. The risk passes to the customer upon handover of the shipment by the carrier. If a parcel is damaged on receipt, report it within 5 days to contact@ube-drink.ch, with supporting photos.

8. Returns and complaints

Swiss law does not provide for a statutory right of withdrawal for online purchases, and UBÉRA does not offer any commercial take-back guarantee: compliant orders are neither exchanged nor refunded. For food-hygiene reasons, no opened or unsealed food product can be taken back.

In the event of a defective product, a damaged parcel or a delivery error on our part, contact us within 5 days of receipt at contact@ube-drink.ch, with the order number and photos. We will then, at our discretion, replace the product or refund it, with the return costs at our expense. The statutory rights provided for in art. 197 et seq. of the Swiss Code of Obligations remain reserved (see Article 9).

9. Statutory warranty

The statutory provisions on warranty for defects in the item sold (art. 197 et seq. of the Swiss Code of Obligations) remain reserved. In the event of a defective product, contact contact@ube-drink.ch; the product will be replaced or refunded, with the return costs at our expense.

10. Liability

The Seller's liability is excluded to the extent permitted by law; liability for gross negligence or wilful misconduct and product liability remain reserved. The information published on the Site is provided for information purposes only and does not constitute health claims.

11. Data protection

The processing of personal data is described in our privacy policy.

12. Governing law and jurisdiction

These GTC are governed by Swiss law. The exclusive place of jurisdiction is the Seller's registered office, Épalinges (district of Lausanne), subject to the mandatory places of jurisdiction provided for by law, in particular in favour of consumers.
